Client: A manufacturer and trader of home furnishing articles

Mandate: To recover dues from a disputed sale transaction

Situation: The client, based in Ahmedabad, had supplied home furnishings to a distributor company in Mumbai. The distributor company had accepted the goods, but later questioned their quality and sought a deep discount. The situation had reached an impasse, with no indication of the payment being made by the distributor company unless the discount was granted.

Resolution: We reviewed the sales documentation and advised the client to call for an arbitration as a pre-litigation tactic. The parties tendered written evidence to the arbitrator. Eventually, an award was declared in favour of the client. The distributor company chose not to appeal against the award and remitted the complete payment.
