MOTHER CAN TAKE CHILD WITH HER WITHOUT FATHER PERMISSION OUT OF CITY OR NATIVE PLACE

if Mother is married and wanted to take son to his native place to attain marriage ceremony but father is not allowing so she can take son directly from school and can go to village so will it be crime or Mother or mother family going to face any legal problems.

Expert Advice

Strictly speaking, there is no law which stops a mother from taking her son to attend a wedding, as long as the child is returned to his paternal home within a reasonable period of time - say, a few days. Neither the mother, nor can any of her relatives be charged with any criminal act for doing so. It must be mentioned that depending on other circumstances, taking the son away for a brief period of time despite opposition by the father may be presented as cruelty by the father. Cruelty is a ground of divorce.
