Conveyance Deed of CHS

My flat is in joint name. The first owner has expired and his will is pending for probate. Society has initiated action for Conveyance Deed for transferring ownership of plot from builder's name to society's name. Society is making the conveyance of my flat in the name of past owner, since first owner has expired and his will is pending for probate. Kindly inform whether society's action is in order and what are the cost and consequences of such an action on me.

Presuming this is in Mumbai just check the facts again, the conveyance will happen to the soceity, just check again in mumbai there will be an undivided land rights to the individual falt owner, which is double conveyance of the same land. ????? i think there are some errors in the facts

The Society cannot make application for conveyance of the Flat in the name of the Deceased Member. The Society should ideally register the Flat in joint name of yourself and the Legal Heirs of the Deceased Member. A deceased cannot be a Member of any Society as per the Law. Once, the Will is probated, the records at the Society and Revenue can be changed as per the Will of the Deceased.
